GENERAL TERMS AND CONDITIONS

PARTICIPANT AGREEMENT WAIVER AND RELEASE OF LIABILITY

We care about all participants who use this facility. We have taken all necessary precautions too ensure the facility is safe for use during manned and unmanned hours.

In consideration of FUNDA Facilities (Enterprise) Ltd T/A FUNDA Gym services and/or equipment to enable me to participate in the Fitness Activities, I agree to the following:

Risks (1) I fully understand and acknowledge that;

(a) risks and dangers exist in my use of the FUNDA Gym equipment and participation in FUNDA Gym activities;
(b) my participation in such activities and/or use of such equipment may result in injury to the body, blindness, heat stroke, heart attack, death or any other ailments that could cause serious injury or disability;
(c) these risks and dangers may be caused by the negligence of the participants, the negligence of others, accidents, breaches of contact, the forces of nature or other causes, and
(d) by my participation in these activities and/or use of equipment, I hereby assume all risks and dangers and responsibility for any losses/accidents/injuries/damages to myself and/or the facility or equipment provided.

Abuse of membership (2) I fully understand and acknowledge the following measures, to which if abused, will result in my membership at FUNDA Gym being reviewed and potentially terminated;

(e) allowing non-members to gain access to the club via opening entry doors for them
(f) Insufficient payments/expired memberships will inhibit restricted access
(g) negligence towards health and safety measures set in place
(h) CCTV is fully operational 24 hours a day for your safety and security whilst on the premises, during manned and unmanned gym hours. Tampering with such equipment is completely forbidden.
(i) Negligent behaviour/violence towards other members/equipment
(j) Stealing or removing equipment from the gym floor

Unmanned Implications (3) I fully understand the following guidelines apply when the facilities are unmanned;

(k) access to changing rooms/showers/lockers will be restricted for the purpose of safety.
(l) access to the drinks fridge or other goods FUNDA Gym provides will be restricted. Access to drinking water will be as normal
(m) key fob access entry through the main access door and side door only. Fire doors in the facility will be functional if required in an emergency

(n) panic buttons located around the gym will be activated, and are only to be used in emergency situations when needing to alert a member of staff and/or emergency services is a priority

I, on behalf of myself, my personal representatives and my heirs, hereby voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify FUNDA Gym and its owners, agents, officers and employees from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of service or otherwise which may arise out of my use of FUNDA Gym equipment or my participation in FUNDA Gym Activities. I especially understand the future of negligent acts or other conduct by the owners, agents, officers or employees of FUNDA Gym.

I HAVE READ THE ABOVE WAIVER/RELEASE AND BY SIGNING IT AGREE IT IS MY INTENTION TO EXEMPT AND RELIEVE FUNDA Facilities (Enterprise) Ltd T/A FUNDA Gym FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE.

RULES OF THE GYM:

MEMBERSHIP

a) Termination: Membership may be cancelled after original membership contract length has been completed, and with 30 days notice in advance. A written/email/document (signed and dated) explaining you’re leaving us is acceptable forms of termination.

(b) Your membership allows you to access the club in accordance to the opening times of the facility.

(c) Your membership applies to you; you cannot loan or transfer it to another person, unless permission is granted through the club manager.

(d) If your membership is terminated before the contract length has been completed (by other means that point A), FUNDA Facilities (Enterprise) Ltd, T/A FUNDA Gym has the right to reclaim the remaining fees via debt collection agency, direct debit or other means of payment.

(e) After your membership contract length has expired, your membership will automatically enrol into a month by month contract, which can be cancelled via point A.

(f) You can freeze your membership, for up to 12 months, with permission from the gym accounts team. This request has to be sent to the gym via email for approval. Requests need to be received before the 24th of each month to avoid the next months payment being taken.

Use your own access fob entry every time you visit FUNDA Gym. As it’s personal to you, please don’t let anyone else use it or gain access via it. We monitor access entry usage by CCTV 24/7 to ensure the safety of our members and misuse may result in us applying additional charges to your membership fees OR termination.

On joining all members are offered a comprehensive induction to instruct you on the use of the gym equipment.

You are strongly advised to undertake this. FUNDA Gym will not accept any liability for any claim for personal injury if you use the gym equipment having not undertaken an induction from a qualified member of FUNDA Gym staff.

Induction bookings can be made via the website, email, reception Or through the FUNDA Gym website.

If you are unsure as to how to use any piece of equipment you must seek advice from a qualified member of FUNDA Gym staff before using such equipment.

For safety reasons, bags are not permitted onto the gym floor and correct attire must be worn when exercising i.e. suitable comfortable exercise clothing and appropriate footwear. Clothing such as flip-flops/sandals or work wear are not permitted. Any member not wearing suitable attire may be asked to leave the gym.

You may not use the gym whilst under the influence of alcohol, narcotics, tranquilizers or any medication or other substance which may affect your ability to exercise safely.

FUNDA Gym reserves the right to remove you from the premises if it reasonable believes you are unfit to use the facilities.

As a courtesy to other members, a small gym towel must be carried Or the use of our sanitizing wipes to wipe down equipment after use.

Can you ensure that you put your weights back in their original place when finished, failure to do so may result in your membership being terminated.

Members are solely responsible for their own belongings whilst visiting FUNDA Gym. FUNDA Gym accepts no responsibility for any loss or damage to personal property or belongings.

You must not behave in an aggressive, abusive, anti-social or threatening manner to any staff or member, anyone doing so will have their membership terminated immediately and FUNDA Gym reserves the right to contact the Police if deemed necessary.

Gym licensed personal trainers are not permitted to train members in the Gym unless granted express permission in writing from FUNDA Gym head office. Anyone else undertaking members’ training will be asked to leave the gym immediately.

Although we will always endeavour to return any articles of lost property to the owner, we do not take responsibility for any item held in lost property. Such items will be kept until claimed, but for no longer than two weeks after which time the items will either be donated to charity or destroyed.

The Changing Rooms will not be available for use between the hours of 5:00am-9:00am and 6:00pm-10:00pm. However, the toilet facilities will be open 24/7.

Members must inform FUNDA Gym of any change of contact and email address or telephone numbers. These changes can be made via email or at reception.

By accessing the FUNDA Gym and using the gym equipment members are deemed to have read and understood the terms and conditions of membership.

Should your Physical Activity Readiness Questionnaire result in you being required to discuss your intention to exercise with your doctor, please be aware that your subscription remains active and any fees collected are non-refundable.

Smoking, including e-cigarettes, are strictly prohibited in all areas of the gym. Any member found to be in breach of this rule may have their membership terminated.

Members may not bring any pets (other than official aid dogs) into the gym.

Please do not misuse the weights by dropping them on the floor, failure to do so may result in your membership being terminated.

Please do not take photographs/videos on the premises or post remarks to the internet that may identify another member failure to comply may result in your membership being terminated.
